GENERAL CONDITIONS AND LIMITATIONS
Your Heartland Window product is warranted to the original homeowner to be free from defects in manufacturing, materials and workmanship. This limited warranty is set forth in this document as the exclusive remedy with respect to all losses or damages applicable to Heartland Windows. As a condition of this warranty, it is required that all products covered by this limited warranty be paid for in full, subject to inspection and be installed according to all installation instructions, applicable building codes and be consistent with normal building practices. No agent, representative or employee of Heartland Windows or Mid-States Millwork, Inc. may modify or expand this limited warranty. Claims under these warranties must be made within thirty (30) days of the appearance of a defect and within the applicable warranty period so that an opportunity may be afforded by Heartland Windows to inspect the product, if necessary. This warranty is not a warranty of future performance, but a warranty to repair, replace or refund. Exclusions from this limited warranty are listed below. Our service department can accommodate most repairs not under warranty, including service trips to the jobsite to provide adjustment or advice for an additional charge to be determined by the nature of the work.
Heartland Windows reserves the right to improve, change or discontinue any window or part thereof that we assemble or substitute products in assembly which are equal to or better in quality without notice. All implied warranties, including merchantability and fitness for a particular purpose, will expire with the 5-year, 10-year or 20-year limited warranty, as noted above. Heartland Windows excludes and will not pay for incidental or consequential damages and its liability will, in all instances, be limited to equivalent current products. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation or exclusion may not apply to you. This warranty gives you specific legal rights. You may also have other rights, which may vary from state to state. All products produced by Heartland Windows require periodic maintenance.
What is not covered by this warranty:
Heartland Windows constructs its products to be durable and long lasting; however, there are some conditions or applications we have no control over. They include:
- Environmental conditions such as acid rain, salt or other corrosive elements, building settling, neglect or misuse and normal wear and tear,.
- Damage to the product caused by water infiltration other than as a result of a defect in manufacturing, materials or workmanship.
- Condensation or frost on the glass is not a defect in the product, but a result of excess humidity. For more information about condensation and suggestions for minimizing it, please contact our office.
- Damage to metal or glass surfaces caused by others, including brick wash, sanding, improper cleaning, washing, building settling, neglect, misuse or normal wear and tear.
- Variations in the color or grain of natural wood parts. Paint or finish treatments including weathering or stains.
- Minor warpage of wood. Heartland Windows may defer actions on any claim for warpage for a period of up to twelve (12) months from the date of the claim in order to permit conditioning and equalizing of humidity and temperature conditions.
- Improper storage, damage after delivery, handling, installation, staining, painting, field finishing, misuse, misalignment, alteration, cracked or broken glass, civil unrest, localized heat, wind born objects, lightning, hail, earthquake, or other acts of God.
- Product use exceeding design standards, after market modifications, removing window parts, sloped glazing or window shading devices (i.e. glass tinting, security systems, etc.).
- Any exterior caulking or sealant shrinkage failures. All units on the exterior of the structure should be periodically checked and resealed, if needed by others.
- Minor glass imperfections that do not affect normal vision or product performance or structure settling.
- Service trips to the jobsite to provide adjustment or instruction on product use.
- Post-manufacturing modifications to the unit made by others (i.e. drilling, cutting, etc.)
GENERAL RECOMMENDATIONS TO BE FOLLOWED REGARDING PROPER INSTALLATION AND MAINTENANCE OF ALL WINDOWS IF THE BENEFITS OF GOOD DESIGN, ENGINEERING, QUALITY MATERIALS AND WORKMANSHIP ARE TO BE FULLY REALIZED
- Prior to finishing, all surfaces should be dry, clean, and free from mold, mildew or any surface contamination.
- Install according to local building codes and use appropriate safety equipment.
- All units must be protected from excessive construction moisture and stored in the upright position before installation.
- Check for the squareness of the unit before installation and the squareness of the wall framed opening.
- Install units properly, making sure that head and sill are level, jambs plumb and shimmed. Use only non-expansive aerosol foams.
- Use tyvek, protecto wrap or factory equal product to create an effective air and moisture barrier per instructions of window wrap product.
- Apply quality sealant to the back side of nailing fin or brick mould nearest the outside edge completely around three sides of the unit leaving bottom open.
- It is the purchaser's responsibility, as soon as possible, after delivery to properly care for and protect all new woodwork against moisture with two (2) coats of good quality paint. Note: Dark colors absorb more heat that can cause wood to expand and contract excessively. Over a prolonged period of time wood deterioration may occur.
- Check installation and operation of unit before application of interior trim being sure that the frame is not bowed (i.e. insulation forced behind jambs, bowed studs, etc.).
- Note: A razor blade should not be used to clean off paint, etc. (use a lexan or plastic scraper). Razor blades can actually scratch the glass causing immediate or delayed breakage and also may cause the exterior weatherproof seal to fail at some future date thereby voiding the warranty.
- Before leaving the job, a few minutes spent in cleaning up and checking the operation of the units will pay good dividends in user satisfaction.
- By installing these products, you are acknowledging that this Limited Warranty is a part of the terms of the sale.
